Acciona submits invoices and supporting documents for €1.957 million to the judge

The documents sent to the Audiencia Nacional include invoices, delivery notes, work logs, time records and emails concerning the Logroño bypass project. The investigation must determine what services were provided and whether the payments had any improper connection to the contract award.

Acciona Construcción has sent the Audiencia Nacional the invoices issued by Servinabar 2000 S.L.U. to the joint venture responsible for the Logroño bypass. The total amount is €1,957,000, including VAT. The submission follows a request from Judge Ismael Moreno, dated July 17, as part of one of the lines of inquiry in the Koldo case.

The documents show what supporting materials the construction company has provided for the payments, but they do not by themselves establish whether all the invoiced work was carried out or whether there was an improper connection to the contract award. Those questions remain under judicial investigation.

What documentation Acciona submitted

In addition to the invoices, the company provided delivery notes and work logs for Servinabar personnel, attendance records, hours worked and records of the vehicles used on the project. The documents also include monthly summaries of workdays and hours, as well as emails exchanged by the technician assigned by Servinabar with workers and managers from the joint venture.

According to information published about the submission to the judge, Acciona says these materials support the invoiced services. The records constitute the company’s documentary account; their contents and whether they correspond to the contracted tasks must be assessed as part of the proceedings.

The context of the Logroño project

The payments relate to work by Servinabar for the Logroño Bypass joint venture, which was involved in building the Arrúbal-Navarrete section of the A-68 motorway in La Rioja. The Guardia Civil had previously flagged this project in its investigation into alleged irregularities in public contracts during the period when José Luis Ábalos headed the Ministry of Transport.

One relevant antecedent is a memorandum of understanding signed in December 2018 by Acciona and Servinabar to collaborate on the project. The contract was officially awarded in September 2019 to a joint venture that included Acciona. Among other things, the investigation is examining the timing and financial relationship between that agreement, the award and the services subsequently invoiced.

What the investigation is seeking to determine

The hypothesis under investigation is whether the payments were for work actually carried out or may have concealed commissions related to the public works contract award. The UCO also analysed communications linked to the project and Servinabar’s relationship with officials and people under investigation in the case. These are lines of inquiry, not a conclusion about the nature of the payments.

The documents submitted by Acciona therefore establish the amount invoiced and the supporting materials the company has provided to justify it. They do not, by themselves, resolve whether the services were performed as described or whether there was an improper quid pro quo: those questions are for the judicial investigation and the assessment of the evidence.
